There's no rule against this in EU law, although the international treaty might possibly say something about it. The EU ratification will only bind Member States to the extent of the powers the EU used when ratifying it - ie it won't cover all aspects of the Istanbul Convention. You write that the EU can (and should) ratify the Convention which would then bind the Union and the Member States. What happens if it does ratify it before them?
